Presumed Consent has Arrived
From the 1st July 2019 a new system comes into place with regards to organ donation. This new system works on the basis of ‘deemed consent’. Practically, this means that unless you say otherwise, you are agreeing to opt in to donating your organs after death.
In certain circumstances, your family may be asked whether you made it known that you intended opt out of the deemed consent system. This is likely to require evidence confirming your intentions. If you have strong feelings about opting out, we recommend that you take the time not only to tell your family and your doctor, but that you make it known formally by opting out via the organ donation register and including your preference in your will.
The organ donation register in Jersey is run by the NHS. You can opt out either online by visiting https://www.organdonation.nhs.uk/register-your-decision/refuse-to-donate/refuse-donation-form/ or by calling the NHS Blood and Transplant helpline.
This system of deemed consent to donate your organs does not extend to the donation of your entire body for medical, therapeutic or scientific research. This is a separate option and special forms need to be completed and specific advice required.
