In support of Mental Health Awareness Week from 13th-19th May 2019, Viberts are pleased to offer complimentary legal advice on mental capacity issues. Namely; when powers of attorney are appropriate and when delegation is required.
We are offering free 30 minute appointments throughout the month of May to those who would like to be informed on this area of law, whether it is relevant to their own circumstances, those of a loved one or someone they care for professionally.
Powers of Attorney
A power of attorney is a legal document under which a person gives another person legal authority to undertake a specific task (a specific power or attorney), or generally to undertake anything that the person giving authority can lawfully do (a general power of attorney). Many people consider granting a general power of attorney to a lawyer or a close friend to assist with their financial affairs such as filing tax returns and monitoring investments. Powers of attorney however are only valid as long as the person who grants the power of attorney retains mental capacity. If they lose their capacity, the power of attorney can no longer be used.
In addition, Viberts can also advise on the new Capacity and Self Determination Law which will come into force in Jersey next April. This will give people the ability to effect lasting powers of attorney more options, both in terms of financial matters and health matters, many of which are not possible at the moment.
At Viberts we have a specialist team which looks after the affairs of clients who either instruct us under powers of attorney to manage their affairs, or where we have been appointed as a curator by the court to do the same.
