In support of Mental Health Awareness Week from 8th-14th May 2017, Viberts are pleased to offer complimentary legal advice on mental capacity issues. Namely; when powers of attorney are appropriate and when curatorships are required.
We are offering free 30 minute appointments throughout 2017 to those who would like to be informed on this area of law, whether it is relevant to their own circumstances, those of a loved one or someone they care for professionally.
Powers of Attorney
A power of attorney is a legal document under which a person gives another person legal authority to undertake a specific task (a specific power or attorney), or generally to undertake anything that the person giving authority can lawfully do (a general power of attorney). Many people consider granting a general power of attorney to a lawyer or a close friend to assist with their financial affairs such as filing tax returns and monitoring investments. Powers of attorney however are only valid as long as the person who grants the power of attorney retains mental capacity. If they lose their capacity, the power of attorney can no longer be used.
In such circumstances, a curator may need to be appointed. A curator is a person (usually a lawyer or close family member) who is appointed by the court to look after the financial affairs of a person who is incapable of doing so themselves. A curator is then legally obliged to look after and preserve that person’s assets.
In addition, Viberts can also advise on the new Capacity and Self Determination Law which will come into force in Jersey next April. This will give people the ability to effect lasting powers of attorneymore options, both in terms of financial matters and health matters, many of which are not possible at the moment.
